To the fullest extent permitted by law, ToyWiz shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Site or purchase of products.

In no event shall ToyWiz’s total liability exceed the amount you paid to ToyWiz for the transaction giving rise to the claim.

9. Arbitration Agreement & Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Any dispute, claim, or controversy arising out of or relating to your access to or use of the Site, your purchase of products, or these Terms — including, without limitation, claims relating to privacy, data collection, cookies, analytics, or advertising technologies — shall be resolved exclusively through final and binding arbitration, rather than in court, except that either party may bring qualifying claims in small claims court.

Arbitration Rules

The arbitration shall be administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules. Arbitration will be conducted on an individual basis only.

Class Action Waiver

YOU AND TOYWIZ AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION.

The arbitrator may not consolidate claims or preside over any form of class or representative proceeding.

Authority of Arbitrator

The arbitrator shall have exclusive authority to resolve disputes relating to the interpretation, applicability, enforceability, or formation of this arbitration agreement.

Governing Law

This arbitration agreement is governed by the Federal Arbitration Act (“FAA”) and survives termination of your relationship with ToyWiz.

Opt-Out Right

You may opt out of this arbitration agreement within thirty (30) days of first accepting these Terms by sending written notice to: legal@toywiz.com.

10. Governing Law & Venue (If Arbitration Does Not Apply)

If a claim is found not subject to arbitration, it shall be brought exclusively in the state or federal courts located in New York, and you consent to personal jurisdiction and venue in those courts.

11. Changes to These Terms

We may update these Terms at any time. Changes will be effective when posted on the Site. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
